Terms of Service for FamPlanIt

Welcome to FamPlanIt! These Terms of Service (“Terms”) govern your use of the FamPlanIt mobile application (the “Application” or “Service”) operated by FamPlanIt (“we,” “us,” or “our”). By downloading, installing, or using the Application, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE APPLICATION.

1. Eligibility and Acceptance

1.1 Age Requirements

Users of all ages are welcome to use FamPlanIt, but specific requirements apply based on age:

  • Adults (18+): You may create a primary account and act as a “Pod Admin.”
  • Teens (13-17): You may use the Application with the permission of a parent or guardian.
  • Children (Under 13): You may ONLY use the Application if your parent or legal guardian has provided consent by adding you to their Household Pod. By allowing a child to use the Application, the Parent/Guardian agrees to be bound by these Terms on the child’s behalf and accepts full responsibility for the child’s activity within the Application.

1.2 Authority

If you are using the Application on behalf of a household or organization, you represent that you have the authority to bind that household or organization to these Terms.

2. Description of Service

FamPlanIt is a family organization application available on Android devices that provides the following features:

  • Pod System: Create or join private groups (“Pods”) using PIN codes to collaborate with household members.
  • Secure Document Vault: Store digital files using end-to-end encryption.
  • Smart Lists: Real-time syncing of shopping, to-do, and packing lists.
  • Family Budget: Track expenses and receive bill due date reminders.
  • Recipe Finder & Pantry Manager: Track food inventory and discover recipes.
  • AisleChat: In-app messaging for Pod members.
  • Family Home Hub: A central dashboard for family updates.

3. Account Registration & Access

To access the Service, you must register an account. The method of registration depends on your user status:

3.1 Adult/Standard Accounts

Users over the relevant age of digital consent must create an account using Google Sign-In. You agree to:

  • Provide accurate and complete information.
  • Maintain the security of your Google account credentials.
  • Notify us immediately of unauthorized use.

3.2 Child Accounts (Restricted Access)

Users identified as children (under 13) are not required to provide an email address or password. Instead:

  • Child accounts are authenticated anonymously via a unique identifier on the device.
  • Access is granted solely via a Pod Code provided by the Parent/Admin.
  • Child accounts are restricted from sharing data outside their designated Pod.

3.3 Responsibility

You are responsible for all activities that occur under your account. For Child Accounts, the Parent/Admin of the Pod is responsible for monitoring the child’s usage and ensuring they do not share sensitive personal information in chat or notes.

4. Pods and Shared Content

4.1 Creating and Joining Pods

You may create Pods and invite others using a PIN code. As a Pod Creator/Admin, you are responsible for managing who has access to your Pod. Do not share your Pod PIN with strangers.

4.2 Shared Information (The “Walled Garden”)

FamPlanIt is a collaborative environment. When you join a Pod, you understand and agree that:

  • No Privacy Within the Pod: All content you create (lists, budget items, photos, chat messages) is visible to all other members of that specific Pod.
  • Child Safety: If you invite a child to your Pod, you acknowledge that they will be able to see the content shared by other adult members of the Pod.
  • Modification: Other Pod members may modify or delete shared content (e.g., checking off a grocery item).

4.3 Content Retention

Content shared in a Pod becomes part of the Pod’s collective history. It may remain visible to other members even after you leave the Pod or delete your personal account.

5. User Content and Conduct

5.1 User Responsibility

You are solely responsible for all content you create, upload, or share through the Application (“User Content”). You grant us a license to use this content solely to provide the Service to you and your Pod.

5.2 Secure Document Vault & Encryption Liability (Critical)

The Secure Document Vault feature utilizes End-to-End Encryption. This means your files are encrypted with a key/PIN that only you hold.

  • Lost PINs: We do not store your encryption PIN. If you lose or forget your PIN, we cannot recover your documents.
  • Liability Release: You acknowledge that FamPlanIt is not liable for any permanent loss of data resulting from lost passwords, PINs, or encryption keys. You use the Secure Document Vault at your own risk.

5.3 Prohibited Conduct

You agree NOT to:

  • Upload content that is illegal, harmful, threatening, abusive, or obscene.
  • Use the Application to harm, exploit, or endanger minors.
  • Share Personal Identifiable Information (PII) of children (such as full legal names, home addresses, or school names) within Pod chats or notes.
  • Attempt to reverse engineer the Application or gain unauthorized access.
  • Use the Application for any illegal purpose.

We reserve the right to remove any User Content and suspend accounts that violate these Terms.

6. Subscriptions and Payments

FamPlanIt offers premium features via subscriptions or In-App Purchases managed by Google Play.

  • Billing: All payments are processed by Google Play. We do not store payment information.
  • Renewals: Subscriptions automatically renew unless cancelled 24 hours before the end of the period.
  • Cancellation: You may cancel via the Google Play Store settings > Payments & subscriptions. Cancellation takes effect at the end of the current billing cycle.
  • Refunds: Refund requests are handled by Google Play policies. We do not process refunds directly.

6.4 Document Storage and Retention (Pro Feature)

FamPlanIt Pro subscribers can upload and store documents securely using the Secure Document Vault feature. The retention of these documents is governed by the following policy:

  • Active Subscriptions: While your FamPlanIt Pro subscription is active, your uploaded documents and their associated metadata are stored securely and remain accessible at all times.
  • Expired Subscriptions (Grace Period): If your Pro subscription expires or is cancelled, your documents will be retained for a grace period of 180 days (approximately six months) following the end of your last paid billing cycle. You may renew your subscription during this period to regain and retain access to your documents.
  • Automatic Deletion (No Recovery): Documents will be automatically and permanently deleted from our servers, along with their associated metadata, after the 180-day grace period has elapsed. Once this deletion occurs, the documents cannot be recovered by FamPlanIt.
  • Pod Ownership: Document retention is determined solely by the subscription status of the Pod Admin (the user who created the Pod). The subscription status of other Pod members does not affect the retention or deletion of documents stored within that Pod.
  • User Responsibility: We strongly recommend that you download any important files from the Secure Document Vault before your subscription expires if you do not plan to renew, to prevent permanent loss of data.

7. Intellectual Property

The Application (code, design, logos) is owned by FamPlanIt. You are granted a limited license to use the Application for personal, non-commercial purposes. You may not copy, modify, or distribute the Application code.

8. Privacy

Your privacy is important. Our collection and use of data—including special protections for children and secure documents—are governed by our Privacy Policy. By using the Application, you consent to these practices.

9. Third-Party Services

The Application uses services including Google Firebase and Google AdMob. Your use of these services is subject to their respective terms and privacy policies.

10. Disclaimer of Warranties

THE APPLICATION IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that the Application will be error-free, secure, or that data will be preserved indefinitely. You use the Application at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, FamPlanIt shall not be liable for indirect, incidental, or consequential damages arising from your use of the Application. This includes, without limitation, loss of data caused by lost PINs or encryption keys. Our total liability is limited to the amount you paid to us in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold FamPlanIt harmless from claims arising out of your use of the Application, your violation of these Terms, or your violation of any third-party rights. If you are a Parent/Admin, this indemnification extends to the use of the Application by the children you have added to your Pod.

13. Termination

  • By You: You may stop using the Application or request account deletion via the app settings or our website.
  • By Us: We may terminate your access if you violate these Terms.

14. Changes to Terms

We may update these Terms. We will notify you of material changes via the App. Continued use constitutes acceptance.

15. Governing Law

These Terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
